The letter was presented to the House Committee on Foreign Affairs, Subcommittee on Africa, Global Health and Human Rights, chaired by Rep. Christopher Smith (R-NJ), as part of Mr. Goldman�s prepared testimony. Mr. Goldman�s complete testimony, including the letter, can be found <a href="http://bringseanhome.org" target="_blank">here</a>. The letter states that �the continued retention of our children violates international law, ethical norms, and human decency. Put simply, our children have been stolen from us.� It goes on to state �there is an urgent need for change, not only to prevent more of our nation's children from being abducted across international borders, but also to effectuate the expeditious and safe return of our abducted children." According to BSHF Executive Director Mark DeAngelis, �the letter shows that these abductions are not isolated incidents and gives a voice to those parents who were not invited to speak at the hearing.� In his testimony, David Goldman, whose son Sean was returned from Brazil after being illegally retained there for more than 5 1/2 years, addressed the flagrant injustice inherent in the present system. Under the Hague Convention on the Civil Aspects of International Child Abduction, Sean should have been returned to New Jersey within six weeks of his abduction. Goldman credited the return of his son to the extraordinary interventions made by Congressman Smith and Senator Frank Lautenberg (D-NJ), and direct appeals to their Brazilian counterparts by Secretary of State Hillary Clinton and President Barack Obama. The majority of the other left-behind parents, however, do not receive the support that David did from their government, and their abducted children remain in unlawful retention indefinitely. Also testifying at the hearing were left-behind parents with children abducted to Japan, Mexico, Turkey, Russia, and Egypt. The number of international abductions continues to increase at an alarming rate. According to the U.S. State Department, in the last three years alone there have been 4,728 American children abducted to other countries. The Bring Sean Home Foundation hopes that this hearing will be the catalyst for lawmakers and the current Administration to come together and pass legislation to strengthen our country�s laws to prevent future abductions and persuade non-compliant countries to return abducted American children more expeditiously. The abductor solicited the assistance of a women�s rights organization in Costa Rica � the Defensoria de los Habitantes, which without checking any of the numerous abuse claims and ignoring the repeated findings against the abductor in both the US and Costa Rican courts, has taken her case and filed petitions on her behalf. Meanwhile, the Costa Rican court dealing with the return of Emily ordered her to be taken into protective custody and returned to the US. Emily was removed to foster care on January 31st, but her return was halted while the abductors and the Defensoria�s petitions are heard. The first petition � that the return under the Hague Convention was unconstitutional � was heard last Friday, February 11th, and the result was a confirmation of the return order. However, in a perverse twist, the Costa Rican Constitutional Court ruled that Emily be returned to the abductor until the second petition, which is egregious and highly controversial, is heard. The abductor is claiming refugee status for her and Emily in Costa Rica from the United States, in a move which could potentially take many months, if not years to decide. This pits the Costa Rican Immigration Ministry against the Ministry of Children and the Ministry of Justice, and flies in the face of the Hague Convention. It is not the first time such a move has been made � Costa Rica has previously granted refugee status to another kidnapping parent, though it was not a signatory to the Hague Convention at that time. Call to Action Costa Rica is very sensitive about its human rights record, particularly in respect to protection of women from claims of domestic violence and abuse. In the case of Emily Koyama, the abductor has made numerous and continuous claims of abuse against the left-behind parent in a well-trodden path to justify child kidnapping. The courts of two countries have thrown her allegations out, yet she and now the Defensoria are making maximum use of them to delay returning little Emily. Please take a moment to email the Costa Rican ambassador in Washington, D.C. with your views on this issue. Let them know that you believe that Emily Koyama should be returned home to her father immediately. Since Sean Goldman returned to the U.S. last Christmas Eve, the "Christmas Miracle," we have continued the work of assisting and counseling parents whose children have been abducted. It has not been an easy task although we have had a few successes thanks to the dedication of our supporters. Maintaining "media coverage" at the level we had for David and Sean has not been possible, but we keep trying. Sadly in Washington, hard core political maneuvering has been the rule in 2010 so we were unable to get the commitment of enough Congressmen and Senators to change U.S. law on international child abductions. Congressman Chris Smith is still our champion in Washington and will be leading the fight for the next two years. Due to privacy concerns and ongoing legal issues we are not able to provide you with details about Sean and David Goldman but can report that things have gone better than any of us had imagined possible. Sean acclimated very quickly on his return, has been doing well in school and has many close friends his own age. It is ironic that he came from a very privileged lifestyle in Rio De Janiero, yet he has flourished living the middle class life of American suburbia. I put it down to "freedom," the freedom to go down the street to play ball with friends or out back on the river that flows behind his home. Compare that to living in a high rise tower, within a secure walled compound with heavily armed guards, and you will understand. <img src="http://www.emilyscase.com/templates/110/img/user/masked/EMILYSCASE.COM.jpg" border="1" alt="Emily Koyama" hspace="6" vspace="4" align="right">The main reason for contacting you is that we need some help to make another "Christmas Miracle." We know that times are very tough for everyone but we have a window of opportunity to help repatriate 2-1/2 year Emily Koyama who was abducted to Costa Rica by her mother. The courts in Costa Rica have ruled in favor of her father, Roy Koyama, and ordered that his daughter Emily be sent back to the United States. This is the very first time that Costa Rica has ruled under the Hague Treaty that an abducted child should be sent home and it's vital that we get her back before any additional delaying appeals are filed. We all know all too well that the legal systems in most countries move at the glacial speed of "dead slow." This historic resolution comes after 58 years of zero cooperation by the Government of Japan on this issue. Of the 231 children abducted to Japan in the last decade, and the countless hundreds more abducted in the preceding decades, none have ever been returned, making Japan quite literally a black hole from which no child ever returns. A Capitol Hill press conference will be held from 1:30 PM to 2:30 PM to discuss the resolution. Speaking at the Press Conference will be Congressman James Moran (D-VA), Congressman Chris Smith (R-NJ), and many victim parents to include Christopher Savoie, Commander Paul Toland and others. Immediately following the press conference, the <a href="http://www.bachome.org/index.htm">Bring Abducted Children (BAC) Home</a> organization, consisting of victim parents of child abduction, will head to the Japanese Embassy for a 4:00 PM rally where the parents will take turns reading lines from the resolution in front of the embassy. When reading the below case updates, please keep in mind the following: <ul> <li>These are not custody issues. These cases are abductions under The Hague Convention. It is clear under the terms and spirit of the Convention that the home state of competent jurisdiction determines ALL custodial issues.</li> <li>Bringing an abducted child home does not separate the child from the abducting parent. It is the abducting parent's choice to live wherever he or she chooses, but again, "The competent court of jurisdiction" meaning the Home State of the child prior to the abduction, which is the habitual residence of the child and under the law, determine ALL custodial issues.</li> <li>To highlight Brazil: It's unacceptable for a country to return an abducted child only when the abducting parent is deceased. The most recent decisions in the Birotte and Weinstein cases exemplify the systemic problem with Brazil and many non-complying countries; and do not go into other likely underlying factors such as nationalism and gender bias when the abductor is a mother. The initial ruling in the Birotte case, though much too long in the coming, was encouraging as it demonstrated that some judges in Brazil do understand the treaty law; however, as shown by Minister Andrighi�s ruling, there are still high level judges that either do not yet understand or refuse to comply with the treaty law.</li> </ul> <img src="http://bringseanhome.org/images/flags/brazil.gif" border="0" width="27" height="17" alt="" hspace="4">CASES IN BRAZIL <a href="http://bringseanhome.org/forums/index.php/board,29.0.html" target="_blank">BIROTTE</a> (US) (hyperlink bolded text to http://bringseanhome.org/forums/index.php/board,29.0.html) Brazil continued to demonstrate ongoing non-compliance for the Hague Convention on Thursday, April 29, when Minister Nancy Andrighi of the Superior Court of Justice (STJ) ruled that Kelvin Birotte, Jr. would stay with his mother, Hilma Caldeira, a former Brazilian Olympian, in Brazil until a final ruling is made on a yet-to-be-filed appeal to the April 14 ruling by the 19th district court in Bellarizante, Brazil, that the boy was to be returned to his father, Kelvin Birotte, Sr., in the United States. In October 2007, the Appeals Court (Tribunal Regional Federal da 2a Regiao) confirmed the decision (3-0 in favor of the return). Again, the ruling was appealed. Despite reports suggesting that a ruling was forthcoming last December and again in February of this year, Francois continues to wait for his case to be heard by the STJ (Superior Tribunal de Justicia). The DR became a signatory to the Hague Convention in June 2007. In Hague cases, the role of a country�s Central Authority is to represent the child in defense of the child�s right to return to the country of habitual residence. However, the DR�s Central Authority, having been approached by Kali�s mother immediately upon their arrival in the DR, seems to be handling this case as a custody battle instead of a Hague case and has twice flip-flopped in their position of representation for Kali. Dhanika Athukorala, Kali�s father, has been working tirelessly to gain his daughter�s return to the United States. They immediately left Brazil and arrived on US soil on Christmas Eve, in what was a true Christmas Miracle. David and Sean are now settled in at their home in New Jersey, and the entire Goldman family is doing very well. We at the Bring Sean Home Foundation (BSHF) thank you for all of your support in helping bring Sean home. David has said that every phone call, every fax, and every email that his supporters sent to government officials, media outlets, and other concerned citizens, made a difference in this nightmare finally coming to an end. Several very reliable sources have assured us that without the efforts of BringSeanHome.org, the Sean Goldman abduction would never have gained such media attention nor reached the highest levels of both the American and Brazilian governments, and we are extremely grateful for all of your hard work, dedication, and perseverance. We would also like to pay tribute to the Bring Sean Home Heroes who helped make Sean�s return possible (see link <a href="http://bringseanhome.org/forum/showthread.php?t=1239" target="_blank">http://bringseanhome.org/forum/showthread.php?t=1239</a>). While we reached our goal of repatriating Sean Goldman back to the United States, we are not satisfied with just one child being returned. There are some 2,800 American children who have been abducted to other countries, and we hope Sean�s return has spurred a larger movement that will result in more children coming home in 2010 and beyond. These children and their left-behind parents deserve the same outcome as David and Sean, and they all need our help. The story of David and Sean has been all over the news this week, since David won a unanimous decision at the Federal Regional Appeals Court in Rio de Janeiro which upheld the return order from June and directed that Sean be turned over to David within 48 hours. Secretary of State Hillary Clinton weighed in with a statement praising the decision, only to have this order suspended by yet another legal maneuver by the Lins e Silva and Ribeiro families, who submitted a writ of habeas corpus to the Supreme Court. That motion was accepted by the reporting judge on the case, Marco Aur�lio de Mello, who stayed the return order the next day. This is the same judge, by the way, who single-handedly blocked the return back in June with another stay order. The media has been closely the story, some doing a better job than others at detailing and explaining the facts, but all have made the fundamental connection that a father is being deprived of raising or even communicating with his son by a wealthy, politically connected family, with the assistance of one Supreme Court Justice. Everyone, Americans and especially Brazilians, know that this is an incredible injustice which cannot be left to stand. It appears that public opinion in Brazil may have shifted with this week�s events, as many Brazilians are reacting negatively to the continued defiance of the rule of law by the families holding Sean, their attorneys, and one Supreme Court Justice who continues to thwart the lower court decisions which unanimously argue that Sean needs to go home immediately. Seth Kugel, a Brazilian based journalist for <a href="http://www.globalpost.com/dispatch/brazil/091218/sean-goldman-custody-battle" target="_blank">GlobalPost</a> recently quoted an anonymous Brazilian following the case: �It�s impressive how the Lins e Silva family achieved an almost unheard of feat in this country: it united the great majority of the Brazilian population in favor of an American! David's legal team has also filed a motion to reverse the stay order and we hope that the President of the Brazilian Supreme Court will take up both writs this week, quash the habeas corpus stay order and send Sean home once and for all. Dear Bring Sean Home Supporters, My apologies for the downtime with the BringSeanHome.org website. The server transfer was not successful but we are now back online as of 2:00 PM Eastern time. Unfortunately there may be a glitch with the Forums - I'm working on that now. With a few more double espressos for fuel I hope to get it operating soon. David Goldman will be will be testifying before the Tom Lantos Human Rights Commission in the House of Representatives on Wednesday December 2nd.
