Brazilian Democrats are charging that the Hague is unconstitutional for allowing an American to take a"Brazilian born child", to the U.S.
 
The DEM's are asking the STF to "annul the decree that approved the participation in the convention"
 
This would be a very bad move for Brazilians. It has already successfully used the Hague to receive children back from other countries.
 
Remember Iruan Wu? I'm sure there have been countless others.
My guess is that the DEM's=the elite ruling party?

Typical behavior of people used to having everything their way.
They are sooooo, pissed off, that things are not going their way that they obviously can't see straight or think straight.
Smells like Dornelles and Vanucchi and a few other crackpots running loco in their appointed roles as master of all.
More than likely, it is their pampered and privleged children who go off to Europe and U.S. to study and come home bringing their offspring, after mating with a foreigner. I doubt most of the average hard working citizens can afford to send their children overseas for an education, so they'll never likely be the subjects of the Hague.

They need to get their facts straight first.
1. Sean was not born in Brazil.
2. Even if he were born in Brazil, his habitual residence was the United States at the time that the petition for return was filed.

I brought this up back in March when Tostes got involved and spoke out publicly, but this is the slippery slope down which his legal arguments were inevitably going to take this case.
 
By arguing that the Hague Convention shouldn't apply to any child who is a "Brazilian born" and defining "Brazilian born" as a child who has a Brazilian mother or father, Tostes has essentially been arguing that the Hague Convention only applies to Brazil in cases where the abucted child doesn't have a Brazilian parent---essentially nullifying the treaty as it applies to Brazil.
 
There is no way that the STF is going to touch this absurd nationalistic plea by the DEM.
 
Brazil would become a pariah on the international stage.

They drop the Hague, so what's gonna happen with Papa Bear's Hague cases he won? Interesting.
I doubt DEM will get the STF to rule that. They will have to go through Congress...Brazilian Congresspeople will rush to vote on issues that affect their own pockets.
