Beautiful children. Horrible situation. For some reason I kept wondering to myself what happens if your ex gets remarried. If my girls (step) said stuff like what your boy said to me, I don't know if I could keep it together. My situation is only 1 year old this week and it is all so raw for me. My wife used to ask why I don't show such enthusiasm for her as I do for the kids. I said "because they're kids!". Why can't some people understand that it is natural to show a little extra expression for kids. Children are tender and I think they need more expressive support. I know my girls appreciate it and keep me in their hearts a little more because they know I always care.
 
Would your kids be ok with you arranging for them to be snatched while on a vacation abroad and sent to you in the US, or if Brazil miraculously sends them back via the Hague?

Hi, everyone

My name is Sean and I send everyone here warm greetings.

My son has recently been abducted by his mother. He is currently being held in southern Brazil, in a small town just outside of Curitiba, Parana.

I will create an introductory post here either today or tomorrow. Let me tell you though that the process of gathering information and documents for the State Department, etc, has me physically and emotionally drained. The fight is worth it, but I pray that G-d gives me strength to continue the fight. My son must be returned to his country.

I do have a question about Interpol:

I have been to their site and research many pages. But I cannot for the life of me figure out how to report the kidnapping of my son by my estranged wife. Would anyone that knows how to do it kindly point me in the right direction?

Again, I will be creating an introductory thread about my case. With background information about my case and how long I have been here at Bring Sean Home Forums as a lurker.

FYI:
I Private Messaged Sean and provided my personal email address and phone number. I looked at an online directory and there are 7 people in Massachusetts with his exact same name(and the right age). Hopefully he will contact me soon so that I can guide him in the right direction. Unfortunately, there are still many more left-behind parents that will come forward.

The same old, same old. Although I was assured that I would see the psychologist's report as soon as it was finished (which happened in January), and asked again over a month ago once I learned that it was given to the judge(in February), I haven't seen it yet. Otherwise, I continue to talk to my son on a near daily basis and my daughter less frequently. His birthday is this Thursday and I will be eating a piece of cake at his request. As for visiting them, I am free during the summer, so I plan on going sometime in June or July. Hopefully by then, there will have been some progress on the legal front. In terms of other things I am working on, I continue to hit roadblocks in obtaining contact information for other left-behind parents. I have now written 3 articles and as soon as Karl Hindle proofreads them, he'll publish the next one.

Thanks for asking. You can be sure that if anything substantive happens, I'll be sure to tell everybody.

It's you. I have not been told an explanation for why I haven't had a ruling since the trial over 13 months ago. Unfortunately, I'm not the only person in the same situation. Kelvin Birotte's trial was within days of mine and he is still waiting for a ruling. At least my case hasn't changed judges 13 times like Ariel Ayubo's.

I'm curious as to why the current pressure on Brazil hasn't resulted in many current cases that have been in the system to be acted on and resolved quicker. You'd think that as the Goldman case is being worked through, that judges would take initiative to handle "expeditiously" those cases which they've yet to make decisions about...I dunno, because of that reason i feel as though Brazil isn't taking things as serious as they should OR they are thinking that as long as they handle Goldmans case, then all is well and have no regard to the other abducted children.

Your case is already in the Federal Court isn't it?  I too can't believe this is continuing, you would think with David's case getting so much attention Brazil would hurry and do the right thing with all the other Hague cases.

My case has been in Federal Court since day one. I think that part of the problem is that Brazil does not have a centralized court system for handling Hague Convention cases. As such, individual judges don't necessarily feel the pressure that we keep talking about. Unfortunately, we have the same problem in the U.S. when we handle incoming Convention cases.

I just informed by the OCI today that the BCA will be receiving soon the psychological evaluation of my children. There are a few things to consider about this evaluation. It was. . .

  • ordered in March, 2008
  • conducted in November, 2008
  • given to the judge's secretary in January, 2009
  • given to the judge in February, 2009
One other things to consider. It is . . .

  • already outdated as the relationship with my children has improved significantly since November, 2008
Where things go from here, I do not know. It is definitely progress, albeit painfully slow.

Like you said, worse case scenario is that they will want to study in America as they become teenagers, despite what mom wants. They will start making their own decisions. Do you use skype to communicate with them? Nowadays these internet cameras have better quality. It's harder when kids are too young to use the internet.

I use the good-old telephone. I have a VOIP plan (similar to Vonage), though one that allows me unlimited calls to landlines in Brazil.

I agree that I am in a much better situation than most LBPs in that I have regular contact with my children. Largely due to language barriers though, I rarely have a complete discussion with my daughter on the phone (in person we can understand each other MUCH better). The answer to your question is "NO". The only way they would be permitted to visit the United States during vacation was if I dropped the Hague case and accepted Brazil as their country of habitual residence. You must remember that in nearly every case, the first thing the LBP obtains is a court order demanding the return, along with custody, of the children.
