A former volleyball player of the Brazilian Chair Hilma said on Friday, told the program "Today", TV Record, which came to Brazil with his son, age 4, with permission of the ex-husband , American Kelvin Birotte. The child's father says that in 2006, mother and son traveled to Brazil to spend three months and did not return to the U.S.. Hilma Birotte accused of kidnapping and attempts to regain custody of the child in court.

"I came here with permission of the father of Kelvin. He was unemployed in the U.S. and came to Brazil with the expectation that he organize our lives there. He said he would get home and a better job, just not this what happened "said Hilma, who cried during the interview.

Accompanied by his lawyer, Gilberto Guimarães, she said she decided to seek separation and not return to the U.S. after Birotte hinted that she would sell their properties. "It made me sad, involve financial situation. He, with his family, said that Texas was great to invest. I understood that he wanted me to sell all my property to get to the U.S.. And this is not correct, then I knew I had to stay in Brazil and ran for Justice. The judge of the 9th Circuit Family of Belo Horizonte (MG) gave me full custody of my son, who is entitled to his father's visit and gave me my separation. I tried Justice to defend myself. "

Hilma also said he hoped that the former came to live with her husband and son in Brazil, where she has financial conditions better than him in the U.S.. "He [Birotte] never helped me. The Kelvin is 4 years and 9 months and he never called asking if he needed diapers or milk. And most important is love, that is the dream of any mother, is to have by the father. Even if the relationship does not work, but the father accompanies his son.'m african-Brazilian woman, we know what is important, especially with son, the father is present at the creation. He never showed interest in wanting me to help. It makes me very sad, "said the former player, thrilled.

The lawyer for former player said that during the time it was in Brazil Hilma waiting to Birotte, he showed no interest in seeing his son. "We know that his passport has seven entries for Brazil, and only two times he tried to Hilma: once to see his son, the other was for an audience. And we know, the press that he already has a regular life in U.S. with another Brazilian. "

Crying, Hilma denied it had kidnapped the child. "There is no kidnapping, it is to want to finish me off. No mother kidnaps her child, a mother always sees the best condition for the child. A mother does not run away from a country with the child if she is okay. What woman wants to build something with the child alone? "The dream of every woman is to have a husband helping, following education, with love, with finance, with everything," he said during the interview.

Decision

Hilma and the U.S. were married between 2004 and 2006. They met when he was a chef in the kitchen of a hotel in Las Vegas. Birotte says that in 2006, mother and son traveled to Brazil to spend three months, and have not returned to the U.S.. On occasion, Hilma had the request for custody of the child rejected by state courts. The father then appealed.

On April 29, deadline for the former player deliver the child to the father, the minister Nancy Andrighi of the STJ (Superior Court) decided that the boy should remain in Brazilian territory, in the custody of the mother, the end of the trial process.

The case recalls the boy's Sean Goldman, delivered to an American father in December by Court decision. Again, the situation involving the Hague Convention, of which Brazil is a signatory, which governs international child abduction.

Here's the "Today" TV Record report:

Former player speaks about the dispute of custody of the child

Hilma was married to American and got custody of the child after divorce

A former volleyball player Hilma, who lived in the United States, divorced two years ago and got custody of the child by the Brazilian courts. However the child's father, who is American, appealed the decision. The Federal Justice of Minas Gerais, then determined that the former player would have to return the child to the father Kelvin.
On April 29, STJ (Superior Court) decided that a child of four years of the former player must stay with their mother.

All of these abductors read from the same playbook, attempting to look like sympathetic figures. The lines Hilma uses are identical to those used by Bruna, Francois' ex and all of the others. As if it was all a big misunderstanding! I wonder what the Brazilians think of the interview. It looks to me like a big sob fest without anyone fairly representing Kelvin's side and the side of the law and an international treaty signed by both countries. Do they discuss the Hague Convention? Minister Nancy Andrighi should be ashamed of her latest ruling in this case, and so should the rest of the Brazilian judiciary. And what next? A reconciliation hearing for Francois Larivee after 5 years??? Oh, and let's not forget the pathetic ruling by the federal judge in the Weinstein case. For all of those who hoped Brazil had turned a corner after Sean's return, think again. It ain't looking so good, is it? Time to get tough with the non-compliant countries folks, Chris Smith had this figured out a long time ago...

Aren't these abductors ashamed of repeating the same lies over and over an over?

I'm a lay person and can figure out these are lies. Why can't the judges???

As with every kidnapper who speaks out, the claims are absurd. The idea that it is impossible for a mother to kidnap her child flies directly in the face of hundreds of documented cases. It never ceases to shock me how uneducated and naive kidnappers presume their audience is.

Wow, quite a performance. If it wasn't for that small snort during the performance, I might suggest that Hilma consider turning out for a part on an upcoming novela. How could she be accused of a kidnapping, how can a mother kidnap her own child? All she did was bring her boy to the great country of Brasil to be around his grandparents and cousins. The boy is handsome and has a beautiful smile (looking at her atty for confirmation). For God's sake, she played Volleyball for her country!!

I contend that all people, particularly Brasilians, can see through this facade. They saw through Silvana's tears, they can see through this performance, too ...

You have to admit, though, she checked all the boxes. Family, country, motherhood, faith, culture, xenophobia, provision, love, persecution, service and she didn't even need to look down at her palm. Quite impressive! Just prior to her slipping into tears, though, I denoted some her true motives (my family, my friends ... selfishness) creeping in to her monologue (fortunately she caught herself and turned on the faucet).

Kelvin Jr. is handsome and he will still have his beautiful smile in Texas, home with his Dad (and Mom if she so chooses).

I'm sorry to burst anyone's bubble, but I think that most people, especially in latin cultures, agree with her that a mother can't kidnap her child and that all mothers want what's best for their children. She probably did herself a lot of good with this performance.

Yeah, it's what most people believe. Unfortunately.

If she'd thrown in the Evil Abusive Father™ she'd have completed the bingo card of abductor excuses.

kittykat,

I'll admit that I viewed this through a prism and vantage point that not all have; probably a poor choice in words. Most likely some, with a more open mind, would have viewed it differently. Most of us wish we were selfless more than we are. When Hilma did adbuct her son, his best interests were not foremost in her mind ... her selfish desires were. She did not want to go through the divorce and custody processes in the US and sought another jurisdiction she felt might be more favorable (or possibly no fight would ensue, at all). After she succeeded in breaking the law, she convinced herself that she wasn't a bad person by justifying her actions to herself and others, making the LBP out to be "the bad guy" to anyone who will listen. I won't listen. I'm sure she has convinced herself that Kelvin Jr.'s new, closer relationship with his brasilian grandparents, uncles, aunts and cousins can replace the void she made when she tried to eradicate his Father from his life. It can't.

She cares about herself first. She makes excuses for her illegal behavior which is not in the best interests of her child. It is her own selfish interest she serves and she goes on television to try and convince, perhaps persuasively, the public otherwise.

I don't buy it either, lovellboys ...

Well, you're obviously not familiar with my literary career here at BSH. I'm one of the strongest opponents of gender discrimination in parenting and feel very strongly about father's rights. In my previous post I was merely pointing out the fact that most people feel that way about mothers or at least will be persuaded to feel that way about any mother that cries. I personally don't feel that way and believe this child should be brought back to the US and have a good relationship with both his parents.

Let Hilma cry foul on national TV. But I have to agree with you on that one, Kittykat. I am from Brazil and I live in Miami, so I can totally relate to your statement. However, I'd like to think there have been some positive changes, not optimal but some; partly due to David's case in the way people are viewing parental rights in Brazil.
With the help of legislation and the media opening its channels (biased or not) to discuss and expose the subject of international child abduction, hopefully it will help end the ordeal of the LBP's.

Her lawyer and she are spouting the same lies and following the same script as the other criminals we've dealt with.  Nothing new here.  This is the Brazilian kidnappers modus operandi.

Interesting they mention the Hague only in passing during the interview, but they mainly focus on the sovereinty of Brazil's government and justice system, and once again, on the child being "established" in the kidnappers country.  Of course, they also focus on the "authorization" of the father for the child to come to Brazil, but forget to mention that it was only for the vacation period, not for a kidnapping.

They are begging their justice system for an "injustice", a judicial lie, once again.  I hope that the Brazilian people see through these lies.  She's no better than Bruna was, running from justice.  A coward.
