American Hague Court doing the Same thing as Brazil and Mexico

Thanks ! yes, I believe what they are referring to is the closing of the "custody" case in NZ after the Hague court refused their return . He than moved to America so he could have some contact rather than none ,and have a family court in the US hear the custody hearing and hope for some visitation rights but only recieved  supervised. That's what i was talking about , Custody cases are to be heard in the Habitual resident state , not the abducting state. The US refused the return so he was forced to come here and have it heard here or have no rights at all. Still sad anyway you see it. :(

Yes, the United States can get Hague cases, and simple child custody and divorce cases, very wrong too.


The issue in the US is the total lack of conformity and quality across family court judges.


Family law is handled by the States.  There is very little family law at the federal level.


Family court judges are not subject to constitutional review or federal appeals (there is, however, an exception for Hague Convention cases where they can be appealed to federal courts if you can afford the legal fees.)


There are some family courts in America with excellent judges, but some are ignorant bigots drunk on power due to their lack of accountability and transparency.


Family law in the US is in dire need of reform and, sometimes, it can be every bit as bad as Brazil or Mexico.

I agree Carlos. It just iritates me that the US is suppose to be a world leader. But even in the case of child abduction and a treaty being signed to send an abducted child back to their habitual residence  and they dont. What kind of leadership is this? It seems to show this is little more than a game to these politicians.
