Thanks for your follow up. Here is the latest. Bienvenidos Supervised Visitation Center in Pasadena CA terminated visitations last week. They tried to say I didn't trust them anymore. What it really was is the lapses in visitation monitoring the past few months. Back in June 2012, the Taking Parent Yuxin Mei Wang had me served with court documents as I was dropping off the kids for a visitation. She was warned. See Rule 4 in attached Supervised Visitation Guidelines.
In July 2012, Wang was served a Notice to Appear by immigration and charged with immigration fraud. She has had 5 Immigration Court hearings and the last was on Dec2, 2014. From what I found out, her case is now with the Board of Immigration Appeals which means she was ordered deported and is now appealing.
During the past 2 months, she violated Bienvenidos Supervised Visitation Guidelines by talking about me during a visit in October (Rule 7), using her cell phone (Rule 11) and then in her November Declaration to request new custody stated she discussed custody and future living arrangements with Christopher during the Nov9 visitation (Rule 6). At first, I didn't believe she actually had this discussion as the monitors would have stopped it. when I questioned Elizabeth Mariscal the Director about it, they terminated visitation and said it was because I didn't trust them any more. If you look at Rule 29 and 30, you don't terminate due to lack of trust, you terminated due to "Non-compliance" with any rule.
I was notified on Dec11. I wanted to minimize the disruption to the visits and started looking for a new center. I found the Ness Center in LA and the Victory Bible Church in Pasadena. Managed to speak with the Ness Center manager on Friday Dec19 and notified the mother to go in for an in-take interview. I didn't hear anything back and instead received an Ex Parte Notice on Monday morning. See attached. We went to Court this morning. I submitted my objections and after 2 hours received the ruling that denied the Ex Parte request and confirmed the current custody and visitation orders.
Back in May 2014, the Judge denied the mother's request for outside visitation and a year earlier denied the reduction of monitors from 2 to 1. The Ex Parte Notice is another attempt to get the boys outside a secure center and using only a single monitor. Her violations of the visitation rules all came in the last 2 months. It could be deliberate on her part to try and get out of the center knowing that visitations would be terminated for additional violations.
Her attorney is the one she had before she started representing herself. Now the attorney is back. She told me she wants to cancel the next hearing on Jan9 and go for a hearing on having the boys interviewed for custody evaluation. The mother has been ordered removed, so why would you change custody only to have her deported in a few months after her appeal fails? Is that in the best interest of the child?
I would ask everyone to write to the Mr. David L Neal, Chairman Board of Immigration Appeals, 5107 Leesburg Pike, Suite 2000, Falls Church, Virginia 20530 and ask them to deny the appeal of Yuxin Mei Wang (A055 170 469).
