That sounds like a great argument for the mother to make... in California courts! And not on the other side of the world. You kinda make yourself look dumb when you say the father is usurping the jurisdiction of CA courts when the mother did that back in Sept. when she overstayed the vacation the court allowed her. Pot calling the kettle black?

If Mr. Walding's statement is accurate he did file in San Bernadino, and was told that Mrs. Walding was no longer a resident in that county and therefore they were no longer accepting jurisdiction. That is why the case is going back to the original county of Gloucester. I guess we'll see this week if he's telling the truth.

I hope the charges are dropped so that she can return and resolve this case in court. She will have no excuses to return, then.

According to bring hannah home the US Embassy promised that there were no charges in December and Deana gave them plane tickets as well promising to come back on the 26th. Not sure if this is a true fact, but it's what is being said. When she never came back on the 26th they gave her a week to get back and told her if she was not back then all charges would be pressed and a warrant issued. She's not just a month late. She left on the promise she'd be back in time for hannah to go to school in september. Again provided plane tickets. Mr. Walding claims he gets Thanksgiving with Hannah and missed that time too. So we have two dates with missed parenting time. I know I was the holding cell officer in on a case last month where the dad was 24 hours late returning his daughter and he was locked up. This type of thing is taken pretty seriously.Interference with a custody order is when one parent purposely does not allow the other parent visitation rights as agreed upon in a court ordered document. Now, is pressing charges really the right answer? I don't know about that. Not so smart if you're trying to get your ex wife to return. Like I said, I think Mr. Walding is a jerk. But, it's definitely a breach of a custody order. And it's definitely a crime. Unless Deana can prove that he gave her permission to stay there.

What she's doing is very wrong and she knows it.  I hope she's thrown in jail.  There is NO excuse for what she is doing to her daughter.  He's moved on, it doesn't matter if he's a jerk, she doesn't live with him.....but the child needs to be with both parents.  It seems as though she is playing a little game here and it's going to bite her in the behind.

He did NOT file in SB Courts, he actually states that the San Bernardino School Board made the determination. There is nothing on file in the State of California showing that California gave up jurisdiction.

How does it make me look dumb? Just because I only mentioned him in this post.  I have already touched on the other issue. I did not realize that I was to do a tit for tat in each post in order to make me look smart. :conf:

I guess the judge will determine on the 11th whether or not he can make a ruling. And then they will have to go from there. Nonetheless, family court is only civil not criminal, anyway. They'll probably only postpone if she isn't there. But if the judge determines he can make a ruling it would go through interstate, meaning he will contact the CA courts and his ruling will stick.

exactly. if he's that awful, why doesn't she just come back here with their child and prove her case.
 
then again, maybe she has a kind of hit-and-run mentality now - she fled and now coming back would sound the death knell for her case.

I worked road detail with Mr. Walding this morning. From the way he talks, he is utterly convinced that she's not ever coming back. Like I said, I have zero doubt that Mr. Walding was probably a total jerk to live with. I don't blame her for divorcing him, as he is rather stuck in his ways and thinks he's funny even though he's really not, but good god, I can't imagine ever wanting to hurt someone that bad. I can't stand my ex husband either but I'd never take his kids from him. I'd never lie to him about where I was taking them or how long we were staying. That was just foolish. I think if she came back now people would side with her, and maybe empahtize with her...and she'd have a fighting chance of keeping parent of primary residence. The longer she stays abroad, the worst she looks. These two parents sound like they had a child wayyyy too early in life and they are too immature to work together to get things right for her. The only one that hurts most in the end, is that little girl.
