I'm not sure how you respond to that.  Bless your heart and theirs.  It is so not fair that they are caught up in this just because she wanted to leave - how selfish that she put her own needs ahead of your children.

Well... we told our daughter that she better think of signing a prenaptual that includes how and where the kids will be should thing don't work out. She is engaged. We would never have thought of that if it was not for David and Sean! May not be very romantic, but it is todays reality. :)

I am with you there. And i hope none of this happens to your daughter. I would sign a prenup that's for sure.;)

The pre-nuptial would need to be signed through courts in both countries. Otherwise, you're simply setting yourself up for a legal battle to get the pre-nuptial recognized in the other country.

My husband and I are in process of adopting and yes, this thought has crossed my mind - what if he took her and ran? :nixweiss: I have no reason to believe he would ever do that, but I'm sure these guys didn't either.  It's such a sad sad situation.  My husband is in the military so I'm quite sure I could track him down.

It continues to happen because there are no consequences whatsoever for the perpetrators.

Unfortunately if you steal money the FBI and Interpol will follow to the end of the world. Steal an american citizen, take it to another country and NOTHING HAPPENS. That has been my experience unfortunately...

I've been pushing the FBI to file for extradition too.  They claim they are "looking into it" and discussing it with the Attorney General, and that they aren't sure that Mexico will extradite (even though I have confirmed that they do w/ my Mexican attorneys and have sent them the laws and shown them cases where Mexico has extradited in the past).  So far, my experience is no different from yours.  Parental kidnapping, especially by mother's, is not a priority for them, and not something they want to make an international issue out of.

I am pushing the DOJ to get a federal warrant for the kidnapper (I don't want to call her ex-wife because a kidnapping is a kidnapping... period, even worse when committed by someone you once trusted...). We must push for this together for our sake, and the thousands of children that will be kidnapped in the future if these bureaucracies fail to recognize this crime for what it really is.

My daughter was taken from me when she was 2 1/2 years old... she is now 22 and brainwashed to think that this was not a big deal and refuses to see me. The daughter that could have been died the day the kidnapping took place and will never come back... isn't this one of the most horrible crimes you can commit against a child and a left behind father or mother and extended family? Yet we, the victims have to push to get what should have been automatically ours which is bringing federal charges and extradition into play...

I asked my senator for Pennsylvania to help me push the DOJ to get the federal warrant and you should do the same. We cannot change the past but we can do a lot about the future and that is the reason why I continue fighting after such a long time.

Hi, just a heads up on my case there are only two cases of abduction from Australia to Brazil at this point in time

Actually, there is another Hague Convention, i'm not sure if it's been ratified by enough countries yet or if Brazil is even one of them, but it's called the Hague Choice of Court convention...or something similiar :) and it allows for contracts to clearly stipulate the country who will have jurisdiction during civil disputes.  I believe it's intent is more for business contracts, but a pre-nuptial is, in a sense, a type of business contract.  Would be something worth looking into if you are marrying someone with strong ties to another country.

For all the fresh new faces we see joining our tight family here, I see the sense of urgency about them.  Take a deep breath and slowly let it out.  We are really making some breakthrough ground work here parents.  I was wanting everything done yesterday, but had to learn things must follow a certain protocal.  Until you're ready to fight HARD...paper trail, paper trail, paper trail, of everything that you do.  Who you spoke with, names, times, dates, what was said, and so on.  That's the 1st thing I learned when I went to court.  Just something I can pass onto you now.
